British Columbia's New Drunk Driving Laws

The latest set of drunk driving laws billed as the toughest in Canada went into effect on the 20th of September 2010. These laws aimed at removing drunk and dangerous drivers from British Columbia's roads. This legislation continues to be enforced and is used to crack down on Canadian and U.S. drivers who occupy the roads throughout British Columbia.

The new laws make it illegal to drive with a blood alcohol reading of more than 0.05. Previously, the level would need to reach 0.08 before fines were imposed or vehicles impounded. This has led some restaurant owners and business leaders in Vancouver and across the region to label British Columbia as a "zero alcohol state."

How the New Drunk Driving Laws Work

The laws are very strict and have recently been the subject of a lawsuit. In December 2011, a judge found certain parts of the law unconstitutional. However, the judge has said his ruling will not take effect until at least June 2012, so the government may adhere to the new law until then.

Drivers charged with impaired driving face severe consequences such as:

  • Immediate 90-day prohibition for refusing to submit to a breath test
  • Immediate driving prohibitions for those who blow .05 or higher (had been .08 before the new law)
  • Up to $4,000 in fines and fees

It is important to realize that these consequences may or may not happen in every case. Because the court decision on the law was so recent, law enforcement may choose to impose penalties under British Columbia's old laws instead.
