Possible Defences for Sexual Assault Allegations
- Proof of identification: Witnesses can sometimes make mistakes in identifying their alleged attackers. DNA evidence or a solid alibi may prove that my clients are innocent.
- Consent: In order for consent to be a valid defence, there must be reasonable evidence supporting the accused's belief that the sexual act was consensual. It cannot be used as a defence if the victim was under the age of 14, or if force or coercion was used in anyway. I will work diligently to uncover the truth and determine if consent is a viable defence option.
- Credibility of witnesses: I work to call into question a witness' credibility by challenging his or her testimony. Effectively doing so may lead to a reduced charge or a dismissal of the case.
- Challenge to evidence: I will challenge any evidence obtained by violating my clients' rights. This may lead to a judge throwing out the evidence and dismissing the charges.
